Yahoo Sues Facebook! - Cam Munger

Yahoo! is filing suit against Facebook for allegedly stealing ten patents that are owned by Yahoo!. The lawsuit included allegations on Facebook’s advertising model, news feed, and messaging features. The world’s largest social media giant was shocked, especially because of the fact that the two companies are business partners. The news of the lawsuit has experts wondering what Yahoo!’s tactics stem from. Yahoo! already has a history of using these aggressive business tactics. One example; when Yahoo! filed a lawsuit against Google supports this notion. Other experts are also questioning if these aggressive tactics stem from Yahoo!’s new CEO who started earlier this year. Scott Thomson came into Yahoo! with a new company restructure plan. His aggressive tactics started with his restructure plan laying off thousands of Yahoo! employees and outsourcing to Boston Consulting Group. In my opinion, Thomas is being forced to maintain such an aggressive strategy because he is facing a recent failed turnaround from his CEO predecessor. The unfortunate issue within this article remains to be that Yahoo! could be looking at the Facebook lawsuit as being a serious financial funder to Thompson’s new restructuring strategy. Facebook has received countless lawsuits in the past and won. The world’s largest social media network is looking to fight Yahoo!’s lawsuit in full.

  1. It seems extremely contradicting that two companies, who have formed a partnership with each other, are now facing suit from one of their partners. I feel that in a situation like this, where a partnership supposedly exists, this is immoral and overly aggressive. We form partnerships with people and organizations in which we think we can strive with. We don't form them with organizations in which we feel will go behind our backs.

    I think that the lawsuit cries desperate. Facebook has been around for years now and yes, so had Yahoo. I feel that if Yahoo felt strongly that facebook was mimicking their patented material they would have gone after facebook much sooner. People could think less of their brand for this reason, or they simply might just overlook the whole thing.

    I feel like Facebook will win this lawsuit, like they have won the many others.

    I'm not sure that this will actually help Yahoo at all. I feel like Thompson was extremely agressive and he is still new to the company. It seems like he didn't waste anytime getting on the bad side of Facebook. Partners are supposed to trust each other and work well together and from this standpoint it seems like Thompson already burned his bridge. I can't see how this is possibly going to help the company find success if they lose this lawsuit.

    I do feel that these tactics are immoral and overly aggressive because if these two are in a partnership this seems a little overboard if you ask me. I am sure there would be another way to work things outs. Yahoo is going after a company that is going to fight for themselves, leaving Yahoo in a bad position.

    I do beleive this well reflect on their image, if Yahoo is going to do this to their partnership with a company, why would any other company want to get involved with them. This is going to make there company look like backstabbers that just want to get to the top no matter what they have to do to get there. I also think that Facebook has the power to make Yahoo loose users as well because of there very large following Facebook could post what is happening and start some contraversy.

    3.What do you think the outcome of the lawsuit will be?
    I think that Facebook will win this lawsuit just like the many other they have won in the past.

    4. Do you think Thompson’s aggressive tactics will turn Yahoo! around for the better?
    I am not to sure of this, his aggressive tactics can be seen as a go getter approach but also one that is to pushy for other companies. With this lawsuit in the mix it could damage his new reputation if things go very wrong. I also understand that he has a lot to live up to, I am just no sure if he is going about it in the right way.

    I believe that Yahoo!’s tactics are coming off a bit strong. I think that they are trying to get their reputation back and get that customer base that they had before all their revivals became more popular. Yahoo is willing to make a public that Facebook stole their patens but they never once showed proof of the matter.

    Yes this lawsuit will reflected on Yahoo!’s brand image because they are just trying to get their name back out there. Yahoo is trying to be like the boy who cried wolf. The more times they file and make themselves look weak they are going to collapse and no one is going to back them up.
    3. What do you think the outcome of the lawsuit will be?
    I think that the lawsuit will be drawn out and the facts will be given that Facebook never stole the pattens that Yahoo had.
    4. Do you think Thompson’s aggressive tactics will turn Yahoo! around for the better?
    It could go either way because if this lawsuit does come out in their favor them yes it could but like I said before if yahoo keeps crying wolf no one is going to listen.

    Yahoo! is acting immorally. Partnerships are created so that their can be a flow of information and for the partnership to be mutually beneficial. Yahoo! looks to be going after Facebook because they are successful and Yahoo! is having trouble competing. Additionally Yahoo! has stated patents have been stolen, but they have not proven that yet.

    This is not the first time Yahoo! has been in litigation, they sued Google as well, another top competitor of Yahoo! Both Google and Facebook have been innovative and first movers in their field. Yahoo! has fallen to the back of the pack and is trying to get the name recognition they once had, but has lost. Yahoo! Fighting gives them some name recognition that they so desperately need.
    3. What do you think the outcome of the lawsuit will be?

    Yahoo! will lose because they have not proven that Facebook has stolen their patents. Additionally Facebook has battled and won in court before and will continue to as they remain an innovative company with multiple competitors struggling to compete.

    4. Do you think Thompson’s aggressive tactics will turn Yahoo! around for the better?

    It's too early to say, Thompson has this litigation to battle through and then we need to see what he is going to do to make Yahoo! innovative and different from the rest!

    I definitely think that Yahoo!’s tactics are overly aggressive, especially for business partners!! Everyone knows you shouldn’t burn bridges and in this case I feel as if the aggression from Yahoo!’s new CEO is going to end up harming the company rather than do anything to help them.

    If Yahoo! Is already being recognized as a company who has recognizable aggressive tactics I don’t think creating lawsuits with a partner is going to help the brand image in anyway. Regardless if the newly named CEO is facing the issue of fixing a failure from the previous CEO, laying off thousands of employees and bringing partners to court is in no way going to be a positive turnaround for Yahoo!.

    3. What do you think the outcome of the lawsuit will be?

    Just like every other lawsuit, I feel as if Facebook will come out victorious, not only because of the brand recognition but because of the size of the site and how many other lawsuits they have been faced with that has not affected them.

    4. Do you think Thompson’s aggressive tactics will turn Yahoo! around for the better?

    Like I said before, I don’t think the aggressive tactics will better the company in any way. If anything, creating such a public lawsuit it will damage the reputation of the new CEO and company. If he is going about things in such an aggressive behavior right out of the gate he will be have a hard time gaining the support and trust from not only employees but business partners which could hurt the company more than the recent turnaround failure.

  6. 1. I do think that Yahoo’s tactics are overly aggressive especially since they are business partners with Facebook. I do understand where they are coming from however because Thompson is coming into a new company that was left in a bad state by his predecessor. He is trying to rebuild Yahoo and bring it to its former glory. I don’t think that going after Facebook is a good idea though because it sends the message that he doesn’t want to work to get things back on top he’s just going to sue Facebook and get the settlement money.
    2. I do think that the lawsuit will impact the yahoo brand image because they are turning into the company that sues everyone. In the future there won’t be any incentive to partner with them because there is a strong possibility that if Yahoo hits a rough patch that they will just sue their partner.
    3. I don’t really know what it could be. While Yahoo may have legitimate grievances against Facebook about the messenger or news feed models they were in a business partnership which raises the question of if they really didn’t know that Facebook was using them. It just seems like Yahoo is really stretching to continue growing.
    4. I think that his tactics have a potential to bring Yahoo around because he is willing to do what it takes to make things better. The issue isn’t his use of aggressive tactics it more about the level of aggression behind them. Some aggression isn’t bad but taking companies to court seems a little excessive.

  7. 1. I think that Yahoo's tactics are selfish, to be honest. My initial impression is that they are "trolling for money" as the video put it. Its a shame that they chose to not settle it personally and privately with Facebook, one of their business partners. I think its a slap in the face to Facebook. They learned about it via social media.
    2. Seeing as Yahoo isn't really making headlines in other regards, yes, I believe that this lawsuit will be reflected on their business in a negative way. I think that more people have Facebook accounts than they do Yahoo accounts, and because of that will likely side more with Facebook. It just seems like a cheesy way of making money.
    3. I'm not too sure how this lawsuit will turn out. They didn't release enough details about the specific patents that Yahoo claims Facebook is using for me to really tell. I do know that Facebook is very smart with their legal business. If Facebook could overcome a lawsuit regarding who originally came up with the idea for Facebook, I think they could probably prevail in patents as well. But who knows! It said that Facebook only has 160 patents, while Yahoo has 3,300.
    4. Its clear that Yahoo is becoming threatened by larger companies like Facebook and Google. They are no longer one of the most prevalent social sites to be on, in my opinion. I think that Thompson's aggresiveness should be redirected. Stop focusing on squeezing money out of other successful companies, and instead focus on revamping Yahoo itself. They need a make over, and a new marketing campaign.

    I would agree that these moves played by Yahoo! are both unnecessary and deceitful. It seems that Yahoo! is losing success fast and furiously, and needed to find some sort of relief to remain competitive. I do not understand why they would even try to attack Facebook. It doesn't seem like one little lawsuit is going to affect such a prosperous and continuously growing company. Love 'em or hate 'em, Facebook is here to stay. I also believe that the timing of the lawsuit was just oh too ironically close to Facebook's IPO. Unless Facebook is seriously hiding some unethical patent stealing that the public doesn't know about, then Yahoo! does not stand a chance in court.

    Does Yahoo! even have a brand image anymore? I can't even think of the last time I was on their website. I think that Yahoo! is on the way out (just like AOL and AIM), and will need to restructure their brand entirely to remain competitive in the world of social media. Their case and reputation certainly will not be helped if they lose this lawsuit.

    3. What do you think the outcome of the lawsuit will be?

    I don't really think I understand the ins and the outs of the case very well to make a sensible prediction, but I can hope that Facebook will win. I also do not need much proof of Yahoo's allegations, and the only patents mentioned seemed very vague. However, definitely a case to keep your eye on.

    4. Do you think Thompson’s aggressive tactics will turn Yahoo! around for the better?

    I definitely do not think that Thompson as the new CEO will benefit the company any more than the last CEO did. It seems that he is far too aggressive and too new to be making such drastic decisions and accusations. I also do not believe that stabbing a business partner in the back for self-gain purposes will help their situation much either.

  9. They are overly aggressive. There really is no reason for them to suit Facebook. This is simply ridiculous in its own right. Yahoo is just trying to find a way to take their comapny to the next level, but doing it in the wrong way.

    This will cause a negative affect on their image especially if they lose. If they lose, which I believe they will, this will make them look like a company that has nothing else to do but blame other companies for their lack of being innovative. Yahoo should think of other ways to set themselves apart from other companies instead of suiting them.
    Thompson's aggressive tactics will hurt the company only if continues to make a lawsuit on competitors. If he maintains his aggressive role and uses it in the right ways he will be successful. Ways such as suggesting new products, new designs, and being agressive twoards staying ahead of their competitors. Those are the areas where he can thrive if he uses his aggressiveness. Being aggressive is not a bad thing by no means. There are plenty leaders who have used their aggressive tactics to maintain and uphold a company

  10. I would say this is absolutely immoral and overly aggressive. In this instance you are two companies working together, supposedly for a common goal. When you have an agreement you are supposed to agree, not go behind the others back and try to hurt your partner.
    I think that this will come back and hurt Yahoo! This is something that could really come back to bite them. The next time that Yahoo! Will go to partner up with a company or organization they might not get the deal made because of this. It could honestly go either way though, so we will see.
    I believe that Facebook is strong enough and will win this.
    I would say the tactics used by Thompson were too aggressive. He is still too new in the company to be going that strong. If they lose this, it could be very bad for not only him but also Yahoo!

  11. I definitely agree with their tactics being strong and aggressive. It is destroying a business relationship and I'm sure facebook is going to remember this in the future, which seems as if it will impact yahoo's business in the end. This will definitely effect the brand image, and I don't know that they can afford that. Aol and Google have seem to already pass by yahoo, I'm sure facebook would have only helped them. No I do not think the aggressive tactics will work. Especially against a business with a brand image such a facebook! It is simply not a smart business move on yahoo's side at all! I am sure facebook will pull through this and find a way to win this battle!

  12. The tactics are clearly too aggressive and unnecessary. However the CEO is new and has other goals. Yahoo has been in the shadow of Google and now of Facebook and the CEO is trying to act, but is this the way to do it? I don't think so.

    I believe that the lawsuit will look very desperate from Yahoo since no one in the outside world really knows about patents and who steels from whom. Therefor people will start questioning if Yahoo will ever be an innovator and will rather think of the company as a parasite.

    I cannot really say how the lawsuit will end, but with Facebook being known for winning most of its lawsuit I cannot really go against them. I personally cannot speculate on this matter because I have no real data to support it.

    Instead of being aggressive on lawsuits I think the CEO should focus on innovation like its competitors are doing. It will not help Yahoo if they are going to court against their partner.

  13. 1. I feel that Yahoo is being overly aggressive because they are business partners with Facebook. They went about this all the wrong way and I feel that they could have made better decisions to fix the problems at hand instead of doing what they did
    2. I strongly feel that it will have a big reflection on the Yahoo brand. Facebook and Yahoo have been around for many of years and it doesn’t matter how many years they have been around or all the good things they have done in that time people will just remember this situation and how Yahoo handled it.
    3. I think Facebook will win, it hasn’t been proven that they stole anything
    4. I think that he is pushing too much and is coming off to strong. He is new and it seems like the power got to his head and his actions will hurt the band of Yahoo

    I feel that Yahoo's tactics are overly aggressive. As stated in the Reuters article, "Yahoo, one of the Web's pioneering companies, has seen its revenues decline in recent years at a time when rivals such as Facebook and Google have thrived." Meanwhile, Scott Thompson is faced with the responsibility of cleaning up the mess of Carol Bartz (the former CEO of Yahoo). I presume that Thompson feels obligated to essentially "re-establish" Yahoo as one of the Web's top companies; however, he is using unfavorable "quick and dirty" tactics that will later hurt the company's image.

    2. Do you believe this lawsuit will be reflected on the Yahoo! brand image? How?

    It is evident that Yahoo has lost a significant amount of leverage and credibility as one of the Web's pioneering companies. In my opinion, Yahoo's lawsuit against Facebook will only damage the brand's image further. As mentioned in my previous response, Yahoo seems to be filing suit against the social media giant as a means of "fast cash."

    I will be quite surprised if the judge fails to see through Yahoo's allegations. With that being said, I presume will Facebook will prevail in this lawsuit.

    I believe that Yahoo!'s tactic is definitely overly aggressive. The reason I think this is because they have a history of doing things of the sort and it does not make sense for them to do this against one of their partners. I don't really think they know what they are getting themselves into going up against Facebook.

    I believe -if people care about lawsuits that companies that they use are involved with, then yes Yahoo!'s brand image will be reflected because of this. If people do not really care one way or the other about lawsuits and such then the Yahoo brand image probably will remain the same to them. I don't think overall it will be ruined for them because not everyone cares. For the people who do care- they're screwed.

    I think Facebook will win this case. It seems like there is background information to support the fact that they win plenty of other cases that people bring upon them. I almost feel like Facebook can do whatever they want anyway.

    No way. I haven't heard of him before this, but if this is his ways of "aggressively" handling things along with everything else he has previously done, then he his losing everything that he needs for a successful company -customers.

  16. Absolutely, the tactics taken by the newly elected CEO of Yahoo! Scott Thompson, to sue Facebook are overly aggressive. He is making his company look desperate by going after the biggest social media giant who just so happens to be their own business partner. Isn’t it a little late to try and attempt to “steal back” an Advertising Model or Messaging features? A partnership is established within businesses in order to benefit both parties… How is this going to improve Yahoo’s status is unclear to me.

    Yes, the lawsuit claimed by Yahoo’s CEO Scott Thompson, will reflect horribly on the company. Facebook is a networking goliath with no signs of slowing down; it seems only wrong to betray a partner of that magnitude in this day and age. I feel this will create an issue for Yahoo moving forward with new partners who can question the loyalty of a partnership.

    The outcome of the lawsuit will be in favor of Facebook. It’s not as if Facebook has not been faced with this situation before where Mark Zuckerberg’s astound attorney’s will step in and defuse the nonsense Scott Thompson has created.

    Thompson must have some motive for the move to push a lawsuit on his own business partner but a plan does not always succeed. My main concern in this issue is the negative image that’s been created and how Yahoo plans to pull it out of the gutter. No, more than likely the lawsuit will not be beneficial for Yahoo and the new CEO Scott Thompson.
